With Congressman Dusty Johnson officially entered in the 2026 South Dakota governor’s race, the grassroots coalition that was successful this past year with the defeat of SB201 and eminent domain laws is now accusing Johnson of misrepresenting the contents of his bill, HR 4135. The group says that the bill quietly paves the way for fast-tracking carbon capture projects despite Johnson’s public assurances otherwise
Speaking to the Pierre Capital Journal, Ed Fischbach, a vocal member of the Dakota Rural Action (DRA) coalition, argued that Johnson has framed the legislation as applying only to water projects. However, after a closer reading, Fischbach argues that it is in fact more specific about carbon sequestration.
